Members of the CEC Council authorize the development of a factual record on the effective enforcement of environmental law regarding submission SEM-21-002 (Vaquita porpoise)

Tiohtià:ke (Montreal), 10 July 2024 — The members of the Council of the Commission for Environmental Cooperation (CEC), in Council Resolution 24-02, unanimously decided to instruct the CEC Secretariat to develop a factual record regarding submission SEM-21-002 (Vaquita porpoise). The submission asserts that Mexico is failing to effectively enforce the General Wildlife Act and its regulations as well as various federal environmental orders, with respect to the protection of the vaquita porpoise (Phocoena sinus) in the Upper Gulf of California.

CEC receives submission on the vaquita porpoise under USMCA/CUSMA Chapter 24

Montreal, 12 August 2021—Yesterday, the Center for Biological Diversity, Animal Welfare Institute, Natural Resources Defense Council, and the Environmental Investigation Agency filed a submission with the Commission for Environmental Cooperation (CEC) under the provisions of Chapter 24 of the United States-Mexico-Canada trade agreement (USMCA/CUSMA). The Submitters assert that Mexico is failing to effectively enforce its environmental laws to protect the vaquita porpoise.

Vaquita Porpoise

The Submitters assert that “the Mexican government is failing to effectively enforce several environmental laws and as a result has caused the near-extinction of the vaquita porpoise. Only approximately 10 vaquita remain.” The Submitters assert that the vaquita population has been declining precipitously for decades due to bycatch in gillnets set to catch shrimp and fish, including totoaba, a large, endangered fish that is threatened by illegal fishing for international markets.

Recovering the Vaquita and Promoting Sustainable Local Livelihoods

The purpose of this project is to support Mexico’s recovery strategy for this species and to steward the implementation of a North American Conservation Action Plan (NACAP), to eliminate incidental bycatch of vaquita.

Vaquita

This NACAP is intended to provide a trinational outlook on the species. It gives an updated account of the species and its current situation, identifies the main risk factors causing the species to suffer an unsustainable level of mortality, and summarizes the current management and actions taken in each country, as well as public and commercial perception of the species and the threats it faces.
