Use of Commission for Environmental Cooperation (CEC) Surplus Funds from Financial Year 1996

THE COUNCIL:

AUTHORIZES and DIRECTS, in conformity with the North American Agreement on Environmental Cooperation and the CEC Council Rules of Procedure, and notwithstanding Financial Rules 5.3, 5.4 and 5.6, that the CEC surplus funds from financial year 1996, which would normally be credited by the CEC against the assessments of the Parties, be used by the CEC in support of the capacity building components of the Sound Management of Chemicals (SMOC) initiative, as outlined in a comprehensive workplan being developed by the SMOC Working Group with the assistance of the Secretariat. Surplus funds would be supplemental to all designated funding allocations approved in the 1998 Annual Program and Budget of the CEC.

AGREES that the Parties, through a joint letter from the Council, will seek to leverage these funds by securing equal or greater funding or other assistance from institutions such as the World Bank, International Development Bank, Pan American Health Organization and other organizations, as appropriate.

FURTHER AUTHORIZES AND DIRECTS that any monies not disbursed as specified above by 31 December 1999 shall be considered surplus funds from financial year 1999 and shall then be disbursed in accordance with Council Resolution 98-10.
